Upper Moreland Police stop man with two prior convictions, faces felony charge after being stopped for third time, according to police

Marvin C Smith, 44, of the 6200 block of N. 18th Street in Philadelphia, faces a felony DUI charge stemming from a traffic stop in Willow Grove, according to police.

An Upper Moreland Police Officer conducted a traffic stop after observing a silver Volkswagon in the area of York Road and Moreland Road without its headlights on and a malfunctioning left brake light, according to police. 

According the officer, the driver, later identified as Smith, had bloodshot eyes, his eyelids were droopy, and there was a strong odor of burnt marijuana present, according to police. 

When asked how long ago he smoked marijuana, Smith replied, “…like a while ago,” according to police. 

Police also observed a dark blue Polo brand lunch box on the passenger seat, which, according to the officer, can contain fresh marijuana based on is experience during previous traffic stops. The officer asked Smith if there was “anything left?” in the blue lunch box, to which Smith replied, “yes, there’s weed in there” according to police. 

Police also seized a partially consumed Jose Cuervo 1800 brand tequila on the front passenger floorboard, according to police documents. 

Smith has two prior convictions for violations of “General Impairment – Drug/Alcohol Combination” within the last 10 years, which makes this offense a third-degree felony charge. 

Upon inspection of the vehicle, the following items were recovered: 

  • One hand-rolled cigarette containing suspected marijuana
  • One Ziploc bag labeled “Lollipop Runtz” containing suspected marijuana
  • One Ziploc bag labeled “D’Runtz” containing suspected marijuana
  • One Ziploc bag labeled “Zashimi” containing suspected marijuana
  • Eight empty Ziploc bags with different labels, each bearing an odor of Marijuana
  • One clear cigar tube, bearing an odor of Marijuana
  • One RAW brand rolling appers
  • Four Entourage brand cigars
  • Three cigarette lighters
